A federal judge has ruled that disputed provisional ballots must be counted in the race for the 15th Congressional District.
U.S. District Judge Algenon L. Marbley ruled Thursday that about 1,000 provisional ballots cast by eligible voters but that were not filled out completely (such as lacking a signature) must be counted.
The Columbus Dispatch reports that five minutes after the ruling, an attorney for Stivers supporters who brought suit, filed an appeal. Marbley has ordered all provisional ballots, about 27,000, not to be counted until Friday, Nov. 28.
Stivers lead grew in the unofficial count by 86 votes to 479 over Kilroy.
