OH-15 case to be decided in federal court

Secretary of State Jennifer Brunner won her fight to move a court case that could help decide the outcome of the 15th Congressional District race to federal court.

The Columbus Dispatch reports U.S. District Judge Algenon L. Marbley has agreed to consolidate a case dealing with provisional ballots with another case that closely mirrors the same legal issues.

Supporters of Steve Stivers (R-Columbus) had originally sought a hearing in the Ohio Supreme Court, but Brunner (D) argued the case belonged in federal court.

Marbley is hearing a motion to temporarily stop counting of provisional ballots until the court decides what criteria must be meet by the Franklin County Board of Elections to count the ballots.

Stivers' supporters say all provisional ballots must have a printed and signed name on the identification envelopes.

Marbley was appointed to the bench by Bill Clinton.
