            CINCINNATI, OH - July 17, 2008 -- American Political Polling (APP) has just conducted a survey of 598 randomly selected registered voters from Ohio's First Congressional District.   The survey was taken over a three-day period ending July 11 and represents the counties of the first district (Hamilton and Butler).

Ohio Ballot Board To Meet June 18

COLUMBUS, Ohio - Secretary of State Jennifer Brunner has called a meeting of the Ohio Ballot Board for June 18, 2008 at 3 p.m. in the Public Utilities Commission of Ohio Hearing Room C, 11th Floor, Continental Plaza, 180 E. Broad St., Columbus, OH 43215.

The ballot board will determine whether a proposed constitutional amendment that would prohibit employers from deducting, without consent, amounts from an employee's wages that would go to organizations that support or oppose a candidate contains only one proposed amendment.

If the board determines that the petition contains only one proposed amendment, it must certify such to the Ohio Attorney General's Office. If the board determines that the petition contains more than one proposed amendment, the board must divide each issue within the initiative petition into separate petitions and then certify each individual petition to the Ohio attorney general's office.

Please note that this meeting has been scheduled ahead of the Ohio attorney general's office's certification of the ballot language. Should the attorney general's office fail to certify the language, the ballot board meeting will be canceled.

Secretary Brunner, as chair of the ballot board, oversees the board's proceedings.

Members of the Ohio Ballot Board include state Sens. Keith Faber, R-Celina and Shirley Smith, D-Cleveland; as well as William Morgan of Stoutsville and Paul Tipps of Columbus.

Secretary of State Releases First Comprehensive Post-Election Report

COLUMBUS, Ohio -- Secretary of State Jennifer Brunner released Wednesday the state's first comprehensive post-election report, focusing on the historic March 2008 presidential primary. 

The report gives an in-depth review of the primary election, along with recommendations to prepare the state for a record-setting general election this November. 

"From our first day in office, my administration has been focused on running safe, reliable and trustworthy elections in Ohio," Secretary Brunner said.  "For the next four plus months, our work in partnership with county boards of elections, the legislature and the governor, will continually focus on preparing for success in November." 

The report includes a thorough description of the primary election experience across Ohio.  In addition to that overview, the report compiles voting machine information for Ohio's counties; official canvass results; secretary of state directives, advisories, memoranda and news releases; and relevant court orders. 

"As we take stock of our experiences over the last year and a half, there are clear recommendations my office will continue to make and implement in the lead-up to November," Secretary Brunner said.

Highlighted initiatives include the following:
  

  • Continue to Promote the Use of Absentee Voting and Reforms to Ensure Ballots are Counted - The secretary of state recently won bipartisan support on legislation for a 10-day window for return and processing of absentee mail ballots postmarked by Election Day.
  • Continue to Improve Accuracy of Registered Voter Database at Boards of Elections - The office will focus on data quality in partnership with county boards of elections.
  • Continue to Improve Poll Worker Training - This summer, the secretary of state will formally launch an online poll worker training program and will renew emphasis on consistent application of election laws across Ohio.
  • Improve Minimum Security, Access, Inventory Control, Storage, and Preservation Requirements for Ballots and Election Data Media - The secretary of state recently won legislative approval for bipartisan teams to transport all ballots and memory cards containing votes.
  • Post-Election Audits in Each County - At the Summer Conference for elections officials, the secretary of state will discuss expansion of the successful post-election audit pilot program to every county.

Ohio Joins 17 States to Stop Tax Relief and Credit Repair Companies


Three companies based in South Carolina faced a lawsuit today by Ohio and 17 other states for violations of state and federal laws for unfair and deceptive practices including misleading advertising and failing to deliver services. However, through negotiations, the companies and their manager John Harris agreed to make changes in business practices in order to be in compliance with the laws and to pay $1.5 million back to consumers in restitution.

A multi-state investigation began in 2004 after several attorneys general offices received complaints about JK Harris & Company, L.L.C., JK Harris Financial Recovery System, L.L.C., and Professional Fee Financing Associates L.L.C. Ohio received more than 90 such complaints. It was found that the companies solicited Ohioans primarily via television advertisements and mailings.


Here are summaries of the three companies and what they did:

JK Harris & Company L.L.C. (JKHC) - advertised tax relief services claiming it could settle debts with the IRS for "pennies on the dollar" by using an "offer in compromise" (OIC) with the Internal Revenue Service. A person has to meet many qualifications in order to make an OIC to the IRS. The investigation found that many people JKHC made this offer to would not have qualified for one to begin with. Also, JKHC in many cases collected fees in advance and did not provide the service agreed upon.


JK Harris Financial Recovery System, L.L.C. (FRS) - contacted Ohioans via mailings that stated the consumer would be facing some sort of court action due to their outstanding debt and that the company could help them get out of that situation for a fee.


The investigation found that in many cases there was no such debt faced by the consumer contacted and after consumers paid the company, they didn't receive the service advertised. Professional Fee Financial Associates L.L.C. (PFFA) - extended credit to consumers who entered into contracts with JKHC-then when JKHC couldn't help the consumer they did not let the person out of their loan.

According to the complaint, JK Harris regularly advertised that it had more than 450 offices nationwide. However, the attorneys general contend that only the main office in South Carolina handled consumers' files. JK Harris also said that consumers' files would be handled by "tax experts" or "ex-IRS agents" when in fact the people handling the cases did not have tax expertise as advertised.

Under the terms of the Order that has been agreed to and is before Judge Julie M. Lynch of the Franklin County Court of Common Peas for her approval, JK Harris must clearly explain to consumers under what circumstances the consumer would qualify to reach an OIC with the IRS on back taxes. JK Harris will also make several reforms to its advertising and sales practices. Financial Recovery Systems is barred from offering or performing credit repair services that don't comply with state and federal laws. Both companies will pay a total of $1.5 million in refunds to consumers. The judgment also applies to Professional Fee Financing Associates, L.L.C, and a related company that provided financing for consumer contracts with JK Harris.

Any Ohio consumer who filed a complaint with the Ohio Attorney General's Office or who files a complaint within the next 90 days will be eligible for a partial refund as a result of the settlement agreed upon today. Consumers can file complaints with our office at 1-877-244-6446 or online at www.ag4ohio.gov.

States participating in the judgment are Arkansas, Arizona, California, Connecticut, Florida, Illinois, Maine, Massachusetts, Michigan, Minnesota, New York, North Carolina, Ohio, Pennsylvania, South Dakota, Tennessee, Vermont, and West Virginia.

Lautenberg, Brown Introduce Bill To Protect Health Care For Children With Chronic And Life-Threatening Illnesses

WASHINGTON, D.C. - Today, U.S. Sens. Frank R. Lautenberg (D-NJ) and Sherrod Brown (D-OH), introduced Children's Health Protection Act of 2008, which would ensure that children suffering from chronic, debilitating and life threatening illnesses have access to comprehensive and affordable health care coverage. Companion legislation has been introduced in the U.S. House of Representatives by Rep. Allyson Y. Schwartz (D-PA).

"We need to do all we can to keep our children healthy, especially for those suffering from chronic or life-threatening illnesses. Children deserve full access to a doctor in their community and the medicine they need to get healthy. Our bill is a critical step in making sure all children get the health care they need," Sen. Lautenberg said.

"Children with serious medical conditions should not be cherry-picked out of their health insurance policies while their families struggle to provide care and pay medical bills," said Sen. Brown. "The Children's Health Protection Act would prevent insurers from blocking children who need medical care the most."

"The current health care system must be fixed: we cannot deny health coverage to those children most in need - those with health conditions or other illnesses. Our plan, the Children's Health Protection Act of 2008, is a much needed, common-sense measure to fix a failed policy that has allowed the insurance industry to deny millions of children the health care they need and deserve. I thank Senators Lautenberg and Brown for working with me as we join to pass this important bill, and move closer to ensuring that ever American child has access to affordable, quality health coverage," Rep. Schwartz said.

The Lautenberg-Brown bill would eliminate a provision in federal law that permits children with pre-existing conditions to be denied health coverage for up to 12 months if they have been without coverage for more than 63 days. The bill would prohibit employers and insurers from imposing pre-existing condition limitations on children up to age 19. This would prevent any more children from becoming uninsurable for their pre-existing conditions.

Twenty percent of school-aged children suffer from a chronic illness. The Health Insurance Portability and Accountability Act of 1996 allowed children to be denied health care coverage due to a pre-existing condition, such as diabetes or cancer, under private health insurance if they went without coverage for more than two months. The Lautenberg-Brown bill would eliminate this provision.

Sens. Lautenberg and Brown and Rep. Schwartz have been strong advocates for expanding children's health care. The three cosponsored legislation re-authorizing the Children's Health Insurance Plan (CHIP), which would maintain health coverage for 6.6 million children nationwide and add four million low-income, uninsured children to the program.
